If you’ve been injured in a car wreck or any other type of accident, I’m sure you’ve got a lot of friends, family, and neighbors—who are very well-intentioned—who tell you about what your value of your case may or may not be. While they may be well-intentioned, they’re probably not very well-informed about the realities of it.
One thing that’s guaranteed about your case is that it’s completely different than any other case that’s ever come before it. This is true whether or not you have the exact same injuries or a different injury. Your case is going to be judged by the facts of your particular case. You could have the exact same injury as someone else, let’s say a broken arm, but the differences will be: how long does it take for your broken arm to heal versus that of someone else? How do you respond? Did you have an infection? Did you have to have a second surgery? Did it take longer because of some condition that you’ve got that someone else doesn’t have?
What about the age of the people? If my father broke his arm and my daughter broke her arm in the exact same spot, the exact same way, who do you think is going to repair and heal faster and be back to normal quicker? Well, of course the younger person would. That makes an impact on it.
Different people have different pain tolerances. The injury can affect people in different ways. What about if a plumber broke his arm versus me? Who do you think it’s going to impact in their day-to-day ability to perform their job and earn a living?
Another factor is insurance. If there is no insurance coverage and the person that caused the problem isn’t able to respond in money damages, then your claim’s not worth very much, as opposed to someone who has a lot of insurance, then that claim has more value.
The guarantees in life are death, taxes, and that your personal injury claim is totally different than anybody else’s.
