What is a wrongful death case and who’s entitled to bring a wrongful death case in Texas? Hi I’m Brad Parker, the attorney you want but hope you never need, and this is another edition of Bar Talk. Give me 90 seconds I’ll give you an answer. Come on in.

In Texas, the people who are entitled to bring a wrongful death claim are the parents, the children, or the spouse of the deceased.  Not aunts and uncles or brothers and sisters, which sometimes can be very problematic because, what about in situations where the children were raised by the grandparents, or there’s twins? Notwithstanding, the close relationship only the parents the spouse or the children of the deceased are entitled to bring a claim. Under a wrongful death claim you’re entitled to recover the loss of companionship, society, support and comfort that was lost as a result of the death of your loved one due to the negligence or pure stupidity of someone else.
