What if you were at fault for an accident? What do you do?
Hi, I’m Brad Parker, the attorney you want, but hope you never need and this is another edition of Bar Talk. Give me 90 seconds and I’ll give you the answer.
So, you’ve been involved in an accident that was your fault. Not someone else’s, but your fault. Well that’s why you buy insurance. The first thing you need to do is call your insurance agent and let them process the claim. An adjuster will be contacting you who has been assigned to the claim and will probably give you a call wanting to find out exactly what happened. After that, they will try to resolve the claim and you’ll probably not know another thing about it.
On the other hand, if they decide that they are going to sue you, you should immediately contact your adjuster again and let them know you’ve been sued and send them the papers. Because under the terms of your insurance policy, they have the absolute obligation to provide you with a lawyer to defend you in that lawsuit. They also have a duty to try to settle that lawsuit within your policy limits.
So, you have two things that you get when you purchase insurance:
- The right to have a lawyer in the event that you get sued;
- The right to have the claim resolved within those policy limits when the claim is made.
