More than a year after the Steiner Ranch wildfire, which destroyed 23 homes, the widow of Travis County Deputy Constable Cpl. Kevin Aigner filed a wrongful death suit as a result of her husband’s collapse and death at the scene of the tragedy.
Travis County Deputy Constable Cpl. Kevin Aigner collapsed and died while helping victims escape the wildfire that consumed 160 acres of land; the cause of the fire is still undetermined.
The Findings of the Investigation
The attorney for Cpl. Aigner’s widow stated that he hoped the wrongful death action would force the City of Austin and Austin Energy, which are named as defendants, to release the findings of the investigation thus far. Mrs. Aigner’s attorney further stated that his team had received some records, but additional documents were withheld due to anticipated litigation.
Over A Year Delay
Meanwhile, it took the Texas Forest Service less than a month to determine how the Bastrop County Complex Fire began when high winds toppled dead pine trees that downed power lines. The delay of more than a year for details of the Steiner Ranch fire is unacceptable to both Cpl. Aigner’s widow and her attorney.
Cpl. Aigner, 38, suffered a “hemorrhagic pontine stroke” while working to help Steiner Ranch residents escape the fire, according to the lawsuit. The suit alleges negligence on the part of Austin Energy for the installation, operation, and maintenance of the pole structure and power lines in the right-of-way near two homes where the fire started.
The suit seeks damages of more than $50,000.
