Hi, I’m Brad Parker, the attorney you want but hope you never need and this is another edition of Bar Talk. Give me 90 seconds and I’ll give you some answers.

What happens if you get involved in a hit-and-run accident and who’s going to pay for your damage? 

If you’ve been involved in a hit-and-run accident, obviously the first thing you want to do is be safe. Get to safety. Hopefully, somebody will have been able to identify a license plate or somehow run that person down or follow them to find out who it is. Hopefully, if you’ve been involved in a hit-and-run accident someone will have taken down the license plate number of the person who ran off. Hopefully, they can then be tracked down and held accountable.

What Insurance Do You Look To?

But oftentimes that’s not the case – they’ll just go on nobody stops there are witnesses that just don’t even come forward. And so, what do you do then? Well, that’s why you have uninsured and underinsured motorist coverage because the only real alternative you have is to file a claim on your own insurance policy. If you don’t have the uninsured and uninsured motorist coverage you really are up the creek without a paddle so to speak.

So, in the event that you are involved in a hit-and-run accident – first and foremost – be safe. Try to get the license plate number of the car that hit you but assuming for a moment that you can’t, call your insurance company and file the claim with your own insurance company.
