One of the biggest questions parents have to face right now is if their child can go back to school safely during COVID-19. While the latest American Academy of Pediatrics (AAP) statement says that children learn best when they are physically in school, returning to the classroom in person needs careful steps in place to keep students and staff safe.

Schools and teachers have a duty to do everything reasonable to protect students from anything that could lead to severe injury or death. This includes providing them with a sanitized and safe environment while they are on a school bus, during the school day and when they are engaged in extracurricular activities. When schools breach this duty to the children in their care, should the school be held responsible for compensating the student for his or her injuries?

School accident claims are very complicated due to the multiple parties who could face liability and the challenges of proving the school’s negligence. In addition, when the school is a public school, you may have to follow special laws that govern suing governmental agencies. “It’s a reality that school districts are immune from liability. I’ve conferred with many parents over the years, and there is little that can be done if a child is injured or catches an illness at school,” Brad Parker says.

Some school districts are requiring parents to sign a waiver for their children to return to schools for in-person instruction during the coronavirus pandemic. The waiver says any parent that signs it assumes the risk and responsibility if their child gets sick or even dies from COVID-19. For those who don’t want to sign the waiver, parents will have to choose one of the district’s virtual or blended learning options.
