If we’ve learned anything in the 30 plus years we’ve been practicing law in Texas, it’s that your life can change in an instant.
That’s exactly what happened to our client, a young woman approaching the end of her first semester of college. As she drove through a green light in the wide-open intersection of Park Vista Boulevard and Alliance Gateway Freeway on the North side of Fort Worth at 7:30 in the morning, a driver ran the red light and T-boned her car.
Just like that, her life changed.
We Proved That There Was No Question of Fault
While it is not always the case in intersection collisions, this time fault was clear.
The other driver, a local high school student, was driving with his girlfriend when he ran a red light at the intersection. Both he and the girlfriend admitted to the responding officer that he was on his phone at the time of the crash and failed to see the red light. He was cited by the officer for disregarding a stop light. With 100 percent of the fault placed on this driver, we were justified in demanding full compensation from his insurance company.
Our Client Suffered Physically and Emotionally From the Crash
As attorneys for injured victims, part of our job is to demonstrate the extent of injury and level of losses to the insurance adjuster.
We do this by presenting medical records and describing how the injuries have affected the day-to-day lives of victims. In this case, our client, who was knocked unconscious by the impact of the collision, suffered intracranial injury, damage to her liver and spleen, and a fractured pelvis and ribs. Because of the liver and spleen damage, she also became anemic.
She was released from the hospital after two days to recover at home. She experienced a great deal of pain and difficulty getting around at home, even with a walker. Her mother had to take a week off work to care for her. She began physical therapy to slowly regain mobility and eventually overcame the damage to her organs.
Our Client Missed Out on Valuable Life Experiences
Aside from her hospitalization and expensive, ongoing therapy, our client experienced significant losses.
At the time of the crash, she was a week away from taking her finals and completing her first semester of college. She was unable to do that. She was a competitive horseback rider and was unable to ride for four months, missing many hours of training and several important competitions.
These losses are harder to quantify, but we presented these facts in our demand letter to the insurance company to explain specifically how this crash affected our client.
We Settled for Maximum Policy Amounts
At Parker Law Firm, we are always prepared to take our cases to trial if we can’t get what our clients deserve through negotiation.
However, trials take time, and our priority is helping our clients get back to their normal lives as quickly as possible. While we don’t want to make a demand until we understand the full extent of a client’s injuries, we do our best to compel the insurance company to settle quickly and fairly.
That is exactly what happened in this case. The insurance company for the young man agreed to our terms, and our client was able to get on with her life.
