We were proud to represent two teenage brothers and their mother from North Richland Hills, TX, in a semi-truck crash case several years ago. On the day of the crash that radically changed their lives, the boys and two close friends were driving from North Richland Hills to Weatherford, OK, to participate in a benefit run for St. Jude Children’s Hospital. Sadly, they never made it. Instead, they would spend the next many months of their lives recovering from their injuries and mourning the loss of their friends, who were killed in the crash.
A Loose Truck Tire Caused the Crash
What made an already horrible tragedy even more unimaginable was that it was all witnessed by the boys’ parents, who were also going to the race in Weatherford and were in a car in front of the boys and their friends. A semi-truck on the other side of the highway lost a tire, which bounced over the divider and into the path of the parents’ car. As the boys’ mother saw the truck tire hit the road in front of them and bounce over them, she turned to see it hit the windshield of her sons’ car, causing it to veer off the road to the right, cross back over the highway, and strike the cable barrier between the eastbound and westbound lanes. The boys’ friends who were seated on the passenger side of the vehicle in the front and back seats were both killed.
Both Brothers Sustained Devastating Injuries
It is heartbreaking to imagine the scene. The boys’ parents rushed to try to help their sons and passengers, only to find their older son unconscious and bleeding profusely. He was trapped in the vehicle and, as his mother held him and tried to stop the bleeding, his younger brother was hysterical at the sight of his brother and his two close friends—both of whom had obviously sustained fatal injuries. It took two hours to extricate the older brother from the vehicle. He was taken by helicopter to Oklahoma City. The younger brother was taken by ambulance. Their mother also suffered injuries in her attempt to help the boys.
In the months that followed, the extent of their injuries became clearer. The older brother sustained several skull fractures and a fracture in his neck. He required surgery and physical therapy while he was in the hospital. It was later discovered that he suffered hearing loss, a loss of his sense of smell, headaches, fatigue, anxiety, and depression. The younger boy also sustained a head injury and continued to experience headaches, nausea, vision problems, and anxiety. The mother has been in counseling to cope with the tragedy she witnessed and began taking multiple medications for anxiety and depression. All of their lives were radically altered. The boys were no longer able to participate in the sports and activities they loved. They were withdrawn and depressed. It took months to work through the psychological issues and physical injuries they suffered.

The attorneys for the truck driver and his employer were anxious to enter into settlement negotiations, but Texas Trucking Injury Attorney Brad Parker was in no hurry. After the case did not resolve in mediation, Brad Parker filed suit in district court in Oklahoma to further pursue the claims in order to receive just compensation. Only after the filing of suit and commencement of discovery did the attorneys for the truck driver and his employer agree to a fair and substantial settlement.
