These Devastated Parents Will Never Recover
Our clients’ only child was the center of their universe. Although never married to each other, they were devoted to their son and worked hard to provide the best possible life for him. Born while his mother was still in college, he was a surprise to both of his parents but one they completely embraced and loved with all their hearts. As Mom moved around to finish her education and find a teaching job, Dad followed closely behind to be near his beloved son. Finally settling near her family in Austin, our client got a job teaching at the same school her son attended. Dad had just signed a lease on a house located on 14 acres—plenty of room for his son’s horse Theodore—and was looking forward to the stability that was to come.
That Fateful Trip
Just like any 6-year-old, our clients’ son was excited about Christmas that first weekend in December 2009 when his grandfather invited him to spend the weekend with him at the family vacation home in Rockport. Flying his private plane, the grandfather promised to have his grandson back for school the following Monday. He didn’t make it. Because of the failure of a part of the navigational system, the grandfather was unable to determine his altitude in a heavy fog resulting in a rapid decent and crashing just short of the Austin airport they were approaching for landing.
Wrongful Death Claims Can Bring Closure
The loss of a child is a heavy burden to bear, and there is nothing anyone can do to lessen the pain. Our clients decided to file a wrongful death claim, not for the money or to ease their suffering, but to hold the liable party responsible for its actions. No laws were broken, so no criminal charges applied, but our clients felt in their hearts that someone should pay for the death of their son, an innocent child who trusted the adults in his life to keep him safe. Once the cause of the crash was determined to be a mechanical failure, we were able to obtain a substantial settlement from the aircraft part manufacturer responsible for the faulty navigation system.
